1. Who we are

Roome Land Surveying is the operating name of Jack W. Roome Surveying, Inc., a Texas corporation. Our office is at 1255 W. 15th Street, Suite 100, Plano, TX 75075. Mailing address: P.O. Box 941647, Plano, TX 75094. We are registered with the Texas Board of Professional Engineers and Land Surveyors (TBPELS Firm #10013100). We provide land surveying services in the State of Texas, with field work concentrated in the Dallas-Fort Worth area.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Site, our systems, or any account or data associated with the Site
• Interfere with, disrupt, or impose an unreasonable load on the Site or any infrastructure used to provide it, including by automated scraping, denial-of-service activity, or repeated form submissions
• Introduce viruses, malware, or other harmful code
• Use the Site to transmit unsolicited promotional or commercial messages
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Reverse engineer, decompile, or attempt to derive the source of any software made available through the Site

3. Forms and submissions

The Site may invite you to submit information through forms (for example, quote requests, feedback, or careers applications). When you submit information through a form, you represent that the information is accurate and that you have the right to provide it. We use the information you submit as described in our Privacy Policy.

We are not obligated to respond to any inquiry, retain any submission, or enter into an engagement based on any submission. Submission of a form does not by itself create a contract for surveying services.

4. Intellectual property

All content on the Site, including text, graphics, logos, photographs, images, drawings, plats, illustrations, and software, is owned by or licensed to Jack W. Roome Surveying, Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws.

Some photographs and illustrations on the Site are not owned by Roome Land Surveying but are used under free-to-use, royalty-free, or other permissive licenses (for example, from public-domain sources or stock-image libraries that grant usage rights). Such images remain the property of their original owners or licensors and are used on the Site in accordance with the applicable license terms.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, publish, display, transmit, or create derivative works from any portion of the Site without our prior written permission. Reuse of third-party images identified above is also subject to the original license terms of the source from which they were obtained.

“Roome Land Surveying,” the Roome Land Surveying logo, and related marks are trademarks of Jack W. Roome Surveying, Inc. Other names, logos, and marks appearing on the Site are the property of their respective owners.

5. Third-party links and services

The Site may contain links to third-party websites or services (for example, payment portals, mapping services, or social media platforms). We do not control and are not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to its own terms and privacy practices.

6. Pay Invoice and third-party payments

Invoices may be paid by a BILL™ payment link (BILL was formerly Bill.com), which we send on request, by Zelle, or by check. We do not add a fee to payments made by card or by ACH bank transfer through a BILL payment link. Payments made through the BILL payment platform or Zelle are processed by those services and by your bank under their own terms and privacy policies. We do not store full payment card information. You are responsible for the accuracy of payment details, including the amount and the recipient. Zelle payments cannot be canceled or reversed once sent; a payment sent to us in error is returned as a refund, to the account it came from.

7. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Roome Land Surveying disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free from harmful components, or that information on the Site is accurate, complete, or current. Information on the Site is for general informational purposes only and is not professional or legal advice. Surveying advice or deliverables are provided only under an Engagement Agreement.

8. Limitation of liability

To the fullest extent permitted by law, in no event will Roome Land Surveying, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages.

Our total liability arising out of or related to your use of the Site will not exceed one hundred U.S. dollars ($100.00).

Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not modify or limit the terms of any Engagement Agreement, which governs the liability associated with our surveying services.

9. Indemnification

You agree to indemnify and hold harmless Jack W. Roome Surveying, Inc., Roome Land Surveying, and their officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.

10. Governing law and venue

These Terms, and any dispute arising out of or related to them or your use of the Site, are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The exclusive venue for any action shall be the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. Material changes will be communicated through the Site or by other reasonable means. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any Engagement Agreement, constitute the entire agreement between you and Roome Land Surveying with respect to your use of the Site.
